It's a more attacking tactic - obviously - and probably increases the chances of a bat pad catch on either side of the wicket, especially with how close Gillespie keeps bat and pad together. Also, generally (unless you pull out a peach like the one to Martyn) you have to rely on the batsman being attacking to take a wicket from LA Over, something that Gillespie isn't all that determined to be.

Well the point is that he shouldn't have done.

If anything, being certain it was out makes it even worse.

maybe the average man off the street could be forgiven for it, but not a supposed "elite" international umpire.
