Laxman is a test team borderline regular (just ahead of Yuvraj and Kaif in the middle-order) but no longer in the one-day team. He was initially left out due to his slow strike rate but now mainly due to his fielding. I'm not basing it on OD performance. I'm basing it on the fact he's the one young gun Aus has got that has any talent and has proven himself at test-level.
