    The problem specifically states that he filed a suit to the supreme court under a specific article which requires infringement of fundamental rights.

    So therefore, The actual problem involves Indian constitutional law. The right of a non-citizen to have locus stadi, jurisdiction of the high court,, availability of fundamental rights to a non-citizen etc.

    The contract and surrogacy part was just a deceptive cover to it.
