It's a boy who cried wolf thing, innit. Not an especially convincing justification for the rule, but I'm sure that's the rationale no less.
Indeed, but take that to its logical conclusion and if a bloke gets acquitted of raping a lass she then becomes fair game for any lothario out for a victim

Whole thing makes me feel dirty TBH, I'm just trying to keep out of it the arguments. If Evans was American though I reckon he'd make an excellent Presidential nominee....

Indeed. That's why I'm uneasy as to the rule's existence.
It reads to me like the ***ual history was only admitted because she said specific consent-giving things during the previous encounters that Evans also reported her having said, lending credibility to his words?

Having read the judgment now in effect you're right.

Still an appalling decision though. When the law on consent changed back in 2003 most commentators thought it meant that blokes weren't going to be able to get away with taking advantage of drunken women - the phrase seems to be that drunken consent is still consent which to me is bollocks - if you drug a woman with illegal drugs and have *** with her that's rape - why should it be any different because the drug is legal or if the woman takes it herself - consent should surely mean informed consent?

Both parties are typically drunk, so wouldnt that imply a lot of cases where both parties have raped each other?

I think the law can deal with that - the key is that the belief that the victim consents must be reasonably held, and what is reasonable can take into account all the circumstances, so if the bloke is pissed some might judge that question differently than they would if he was sober - personally whilst I might buy that for a ***ual assault or even an assault by penetration I wouldn't for rape - if a bloke can get it up then in my view he knows quite enough about what he's doing to be able to make sure the other person involved consents

TBF he's been due one, mind you that rule rarely seemed to work with Paul Scholes and now Diego Costa.

You won, so I'm sure you'll get over it.
