What we essentially do when we link from here is trust that the uploader of the file holds the copyright, or rights to the video. I'll say no more than that, 'cause though I think the policy here is a bit arbitary, I don't really want to endanger the ability to link to Youtube in future, as I don't believe we'll get in any trouble doing so.
